Special Needs Trust

A trust created pursuant to federal law for the benefit of persons who are under the age of 65 who are disabled. If the trust is established and implemented correctly, any assets placed in the trust do not count for purposes of needs based public benefit programs such as Supplemental Security Income (SSI). There are also special rules regarding these trusts for individuals living in public housing or who are veterans. Federal law also allows individuals to establish a sub-account in a pooled special needs trust.
